Mortgage Lending Law/Loan Negotiations and Modifications
A broad array of lenders have relied on our legal counsel in the negotiation and preparation of all forms of loan and security documentation to fit each particular transaction. Whether it is a purchase money loan, refinance, modification or restructuring of an existing loan, construction loan, loan secured by leasehold or build-to-suit lease, whether we are dealing with homestead, raw land, improved land, income producing property, or a new or ongoing business, the debt instrument and security documentation are specifically structured to fit each particular transaction, and all support documentation to cover all the risks involved in each loan transaction are obtained and thoroughly vetted before closing. We also represent clients in collections, repossession and foreclosure.

 

Real Estate Title Examination/Title Insurance
The attorneys of Timberlake & Weaver, P.C. fully recognize the importance of an accurate title examination, and the vital role it plays in any successful real estate transaction. Since its inception as a pioneer of the title insurance industry to the South Plains of Texas, Timberlak &, Weaver, P.C. has been widely regarded for its experience in the field of title insurance, and in the preparation of a vast array of title curative documentation. Our attorneys work diligently to stay current on all changes to the Texas Title Insurance Code and the Texas Title Insurance "Basic Manual" of Rates, Rules and Forms promulgated by the Texas Department of Insurance in order to provide our clients with the highest quality of representation.

 

Real Land Development/Land Use
For over 60 years, the attorneys of Timberlake & Weaver, P.C. have worked with and represented municipal planning and building code departments, surveyors, engineers, architects, builders, construction management teams, lenders, developers, and other real estate professionals in negotiating and drafting documentation for raw land acquisition, platting and subdivision, infrastructure, utilities and easement negotiation and drafting, zoning issues, construction contracts, architect agreements, etc. from small residential or commercial projects to large scale apartment complexes, retail centers or mixed use developments.

 

Lease Negotiations and Modifications
Timberlake & Weaver, P.C. represents property owners and prospective tenants in a wide range of leasing and management activities, including commercial office, industrial, and retail space. Probate/Estate Planning
We provide advice and counsel for a variety of small estate planning matters, including wills, trusts, powers of attorney, health care directives, guardianships and conservatorships. Most of our estate planning representation involves a real estate component, as an individual's home or commercial real estate is often the single largest investment they will make during their lifetime, and our attorneys advise clients as to the best method to probate a will or administer the estate of the deceased, and guide the client through the various steps and proceedings needed to ensure that the assets of the deceased are distributed according to their wishes, and that their heirs have good title to their property.
